Terms of Use

1. Acceptance of these terms

By creating an account, submitting a vision, generating a vision, or otherwise using OULY City, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please don’t use the service. These terms form a binding agreement between you and Typeface s. r. o., and they apply to the OULY City mobile app, the website at ouly.city, the public city map, and every feature we offer through them.

If you use OULY City on behalf of an organisation, you confirm that you are authorised to accept these terms on its behalf, and “you” then refers to that organisation.

2. Eligibility

You must be at least 16 years old to use OULY City. Sixteen is the digital-consent age in Slovakia, where the service is operated. There is no parental-consent exception: OULY City is not intended for children, is not marketed to them, and carries no content made for them. If we learn that an account belongs to someone under 16, we close it and delete the data associated with it.

You also confirm that you are not barred from using the service under the laws that apply to you, and that you will use OULY City in compliance with all applicable laws and regulations.

3. Your account

You sign in with an email address and password, your Google account, or your Apple account. You are responsible for:

• Keeping your login credentials secure and confidential.
• All activity that happens under your account.
• Providing accurate information and keeping it up to date.
• Maintaining a single genuine account that belongs to you, not to a bot or another person.

Tell us promptly if you believe someone has accessed your account without your permission. We are not responsible for losses caused by credentials you failed to keep secure.

4. The service

OULY City is a social network for cities. You photograph a real, public place, and our AI generates a before-and-after vision of how that place could one day look. These visions can be shared publicly in the feed and shown on the public city map. The service is currently in beta in Poprad, Slovakia, and is evolving quickly.

Every AI vision is conceptual and illustrative only. It is a piece of creative imagination – not a real construction proposal, architectural plan, permit, factual claim, or statement about what will actually be built. It does not reflect any decision, plan, budget, or endorsement by any property owner, developer, architect, municipality, or public authority.

We may add, change, suspend, or remove features at any time, and because the product is in active development, parts of it may be incomplete, change without notice, or stop working.

5. Your content & licence

You keep ownership of everything you submit – your photos, voice recordings, transcripts, vision text, and the AI visions generated from them (your “Content”). You are responsible for the Content you contribute and for having the rights to share it.

By submitting Content, you grant OULY City a worldwide, royalty-free, non-exclusive, sublicensable licence to host, store, process, adapt, reproduce, and publicly display that Content in order to operate, improve, and promote the service – including showing your Content on the public city map, in the feed, and in our communications and marketing about the platform. This licence continues for any Content you have made public, even after you stop using OULY City, to the extent needed to operate the map as a civic record; you can ask us to remove specific Content as described in the Privacy Policy.

You warrant that you have all the rights needed to submit your Content – including the rights to the source photos you capture – and that your Content, and our permitted use of it, does not infringe anyone’s rights or break any law.

Vision photos must be live camera captures of real, public places. This is what keeps OULY City authentic. No gallery uploads, no screenshots, and no fabricated or AI-generated images submitted as the original photo of a place.

If you send us ideas, suggestions, or feedback about OULY City, we may use them freely and without any obligation to you.

6. AI-generated content

OULY City uses artificial intelligence – including services provided by OpenAI – to transcribe your audio, analyse your photo, and generate “after” visions of how a place could look.

These visions are an illustration of what a place could become – not real plans, approvals, commitments, or guarantees. They are generated by AI as a creative interpretation derived from your photo. They do not represent any decision, endorsement, or undertaking by the city, by any property owner, by OULY City, or by anyone else. You must not present them as official plans or as anything more than imagination.

AI output is provided “as is”. It may be inaccurate, distorted, unexpected, or fail to reflect what is physically, legally, or financially possible. You use and share it at your own discretion and risk, and you are responsible for how you use any output you create.

Rights in AI outputs may be uncertain and can vary by jurisdiction. We make no promise that any vision is original, protectable, or free of third-party rights, and you are responsible for checking before you rely on or reuse it.

7. Acceptable use & prohibited conduct

OULY City is meant to inspire a positive, constructive vision for our cities. You agree not to use the app, the AI features, or any output to do, post, submit, or enable any of the following:

• Harming property. Using the app or any AI transformation to damage, deface, devalue, vandalise, “downgrade”, or threaten a person’s or organisation’s property, or to depict their property in a degrading, false, or harmful way.
• Targeting real people. Targeting, defaming, harassing, bullying, intimidating, threatening, or doxxing any person, or depicting, generating, or transforming a real, identifiable person without their consent.
• Misleading about real plans. Presenting AI visions as real, approved, or planned changes, or otherwise using outputs to mislead anyone about the actual plans, condition, or value of a property, municipality, or public authority.
• Impersonation. Impersonating any person, business, brand, or public body, or misrepresenting your identity or affiliation.
• Illegal or harmful content. Posting content that is illegal, hateful, discriminatory, violent, threatening, sexual or pornographic, that exploits or endangers minors, or that promotes self-harm, terrorism, or other serious harm. Specifically and without exception, any material depicting child sexual abuse or exploitation (CSAE/CSAM) is forbidden; we remove such content immediately and terminate the account permanently.
• Infringing content. Posting content that infringes copyright, trademark, privacy, publicity, or any other right, or that discloses someone else’s confidential or personal information without permission.
• Misusing the platform. Spam or advertising, gibberish or content with no genuine civic purpose, off-topic content unrelated to a city or community, or any deceptive, fraudulent, or otherwise objectionable content.
• Attacking the service. Hacking, probing, or disrupting the service; bypassing rate limits or security; scraping or harvesting data; using bots, automation, or fake accounts; or reverse-engineering or misusing our AI systems.

We check submissions with automated tools: the text of a vision, chat messages and the photo all go through machine screening before they are published. When someone reports content to us, we assess it and decide. Abuse, repeated violations, or attempts to game the platform can lead to your content being removed, your account being suspended, or a permanent ban.

We have zero tolerance for objectionable content and abusive users. Content that breaks these rules is removed and the account behind it can be suspended or terminated.

If you come across content that breaks these rules – including a vision that targets your property or you – please report it in the app or contact us, and we will review it.

We review every report without undue delay – in practice within 24 hours.

You can also hide any author yourself, from the vision detail in the app. Their visions disappear from your map and feed immediately, they are not told, and you can unhide them at any time in your profile.

8. Public & anonymous visions

Browsing the city map is anonymous – you don’t need an account to look around. Contributing requires an account.

We never show your name publicly next to a vision – whether or not you choose “anonymous”. Only city admins of the city where you post it and OULY City administrators see it; choosing “anonymous” hides it from them too. The vision still stays linked to your account until you delete it – it is a display choice, not full anonymity. When you delete your account, your published visions are anonymised and kept as a civic record, while your pulses are deleted. The photo and the AI image of a published vision stay at their public address; the voice recording and its transcript are always deleted, published visions included.

9. Pulses

• You may cast one pulse per vision.
• Be respectful toward other people’s contributions.

10. Fair use & limits

To keep the service healthy and available for everyone, we apply rate limits to prevent abuse and cap automated and AI usage. Excessive or automated requests may be throttled or blocked.

11. Intellectual property & infringement

The OULY City name, logo, app, website, design, and software are owned by Typeface s. r. o. or its licensors and are protected by intellectual-property laws. These terms don’t give you any right to use our brand or technology except as needed to use the service normally.

We respect intellectual-property and privacy rights and expect you to do the same. If you believe Content on OULY City infringes your rights or depicts your property or person without consent, contact us at info@ouly.city with enough detail to identify the Content and your claim, and we will review and, where appropriate, remove it.

12. Privacy

How we collect and use your data is explained in our Privacy Policy. By using OULY City you also agree to that policy. It covers what we collect, how AI providers process your photos and audio, your rights under the GDPR, and how to delete your data.

13. Moderation, suspension & termination

We may moderate, remove, or restrict any Content, and we may suspend or terminate your account or access, with or without notice, if you breach these terms, misuse the service, repeatedly violate the acceptable-use rules, or where we reasonably need to in order to protect users, third parties, or the service.

You may stop using OULY City and delete your account at any time from within the app.

Sections that by their nature should survive – including content licences for Content you made public, disclaimers, limitation of liability, indemnification, and governing law – continue to apply after termination.

14. Disclaimers

OULY City is provided “as is” and “as available”, and the service is currently in beta. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. AI output may be inaccurate, incomplete, or unexpected. We don’t guarantee that the service will be uninterrupted, secure, or error-free, and we make no guarantee that any city, authority, or other party will see, respond to, or act on any vision submitted through OULY City.

15. Limitation of liability

To the fullest extent permitted by law, OULY City and Typeface s. r. o. will not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profit, data, goodwill, or reputation, arising from or relating to your use of the service.

Without limiting the above, and to the fullest extent permitted by law, we are not liable for any damage to, or loss of value of, any property, or for any decision, action, investment, or reliance based on an AI vision or any other Content – these are conceptual and not statements of fact.

Our total liability for any claim relating to the service is limited to the greater of the amount you paid us (if any) in the twelve months before the claim, or fifty euros (€50). Nothing in these terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud.

16. Indemnification

You agree to indemnify and hold harmless OULY City and Typeface s. r. o., and our team, from any claims, damages, losses, liabilities, and reasonable costs (including legal fees) arising from your Content, your use or misuse of the service, your breach of these terms, or your violation of any law or of anyone else’s rights – including any claim that a vision you created or shared harmed a person, a property, or a third party.

17. Governing law & disputes

These terms are governed by the laws of Slovakia and, where applicable, of the European Union, without regard to conflict-of-laws rules. OULY City is operated by Typeface s. r. o., based in Poprad, Slovakia.

We would much rather sort things out informally, so please contact us at info@ouly.city before taking any other step. Any dispute that cannot be resolved this way falls under the jurisdiction of the competent courts of the Slovak Republic. If you are a consumer in the EU, you keep the mandatory protections of the law of your country of residence. If you are not satisfied with our answer, you may file a proposal for alternative dispute resolution under Act No. 391/2015 Coll. – for Slovakia the body is the Slovak Trade Inspection, Central Inspectorate, Department for International Relations and Alternative Consumer Dispute Resolution, Bajkalská 21/A, p. o. box 29, 827 99 Bratislava (soi.sk), or any other body listed by the Ministry of Economy of the Slovak Republic.

18. Changes to these terms

We may update these terms from time to time as the product evolves. When we make material changes, we’ll update the “Last updated” date above and, where appropriate, let you know in the app. Continuing to use OULY City after changes take effect means you accept the updated terms.
